MINISTRY OF ENERGY AND WATER RESOURCES OF THE REPUBLIC OF TAJIKISTAN
I. General provisions
1. The Department of Water Resources of the Pyanj Basin of the Ministry of Energy and Water Resources of the Republic of Tajikistan (hereinafter – the regional structure), the regional structure of the Ministry of Energy and Water Resources of the Republic of Tajikistan at the basin level, which performs the tasks assigned to it, including the organization of integrated water resources management, water use planning, monitoring the use of water bodies and implementation of water management plans in the Pyanj Basin.
2. The regional structure in its activities includes the Constitution of the Republic of Tajikistan, constitutional laws of the Republic of Tajikistan, laws of the Republic of Tajikistan, internationally recognized regulatory legal acts of the Republic of Tajikistan, decrees of the President of the Republic of Tajikistan, decrees of the Government of the Republic of Tajikistan, provisions of the Ministry of Energy and Water Resources of the Republic of Tajikistan and this Charter are the guiding principle.
3. The regional structure carries out its activities in cooperation with other state bodies, local executive bodies of state power, state, public and other organizations.
II. Powers, rights and obligations
4. The regional structure has the following powers in the established areas of activity:
-organization of integrated water resources management in the basin zone;
-participation in the development of seasonal, mid-term and basin water management plans;
-coordination of the process of participation of subjects of water relations and stakeholders in the development of basin plans for water resources management in the basin;
-monitoring of water bodies together with other specially authorized state bodies;
-coordination and monitoring of the implementation of basin plans for water resources management;
-drawing up the balance of water management in the basin zone and informing the subjects of water relations about the available water resources;
-coordination of the activities of the subjects of water relations to ensure the efficient use of water resources;
-implementation of state accounting of water use of water bodies and maintenance of the state water cadastre in terms of water use of water bodies in the basin territory within the limits of their authority;
-monitoring the schedule of operation of reservoirs for complex purposes;
-acts as the secretariat of the Panj District Council;
-provision of relevant information for inclusion in the National Water Information System;
-organization of advanced training of employees of regional structures, their retraining, advanced training and advanced training of employees;
-performing other tasks in the established area of its activities, if such functions are provided for by laws, regulatory legal acts of the Republic of Tajikistan.
5. The regional structure has the right, in order to implement the established powers in the field of its activities:
-explain to individuals and legal entities issues related to the activities of the regional structure;
-to involve scientific organizations, other organizations, as well as scientists and specialists in the study of issues related to the activities of the regional structure;
-create a consultative and advisory body to discuss the issues of the established structure in the field of the regional structure;
-in the prescribed manner, information from the central executive body of state power, local executive body of state power, bodies and organizations of city and rural self-government, regardless of their structural and legal form, to request and make decisions on issues related to the competence of the regional structure;
-make recommendations to the authorized state body in the field of environmental protection on issues of issuing permits for special water use in the territory of the basin zone.
6. Obligations of the regional structure:
-organization of work in the system of the Ministry of Energy and Water Resources of the Republic of Tajikistan according to the tasks defined in the main directions of its activities;
-ensuring the implementation of the approved work plan and activities;
-ensuring timely and high-quality fulfillment of tasks assigned to the employees of the regional structure, determined by this Charter and job descriptions;
-fulfillment of instructions of the Ministry of Energy and Water Resources of the Republic of Tajikistan;
-Submission of reports on the work done to the Ministry of Energy and Water Resources of the Republic of Tajikistan;
-fulfillment of other duties arising from the powers of the regional structure.
III. Organization of activities
7. The regional structure is headed by a chief, who is appointed and dismissed by the Minister of Energy and Water Resources of the Republic of Tajikistan in accordance with the legislation of the Republic of Tajikistan.
8. The head of the regional structure carrying out the activities of the organization is personally responsible for the implementation of the established powers.
9. The deputy head of the regional structure is appointed and dismissed by the Minister of Energy and Water Resources of the Republic of Tajikistan in accordance with the legislation of the Republic of Tajikistan.
10. Head of the regional structure:
-appoints and dismisses employees of the regional structure in agreement with the Deputy Minister of Energy and Water Resources, who is the supervisor of the industry;
-distributes responsibilities between its employees;
-publishes organizational and administrative documents;
-in accordance with the established procedure, appoints and dismisses employees of the regional structure in agreement with the Deputy Minister of Energy and Water Resources of the Republic of Tajikistan, who is the supervisor of the industry;
-make decisions on the recognition and imposition of disciplinary sanctions on employees of regional structures;
-in agreement with the Ministry of Energy and Water Resources of the Republic of Tajikistan, approves the structure and structural divisions of the regional structure within the established number of employees and the wage fund;
-Approve the instructions for the work of the regional headquarters
-represents the interests of the regional structure in courts, government bodies and other organizations without a power of attorney, manages the funds and property of the regional structure in accordance with the legislation of the Republic of Tajikistan, concludes agreements and issues powers of attorney;
-Operational management of the property of the district organization in accordance with
-implements the legislation of the Republic of Tajikistan;
-exercises other powers in accordance with the legislation of the Republic of Tajikistan.
11. The regional structure in relation to the property transferred to its operational management exercises the right of ownership and use for the purpose of its activities, the designated purpose of the property in accordance with the legislation of the Republic of Tajikistan and orders of the Ministry of Energy and Water Resources.
12. The regional structure has no right to alienate or otherwise dispose of the property transferred to it for operational management without the consent of the Ministry of Energy and Water Resources of the Republic of Tajikistan and the State Committee for Investments and State Property Management of the Republic of Tajikistan.
13. The regional structure is the recipient of funds provided in the state budget for the financing and functioning of the regional structure.
14. The regional structure is a legal entity that has a seal with the State Emblem of the Republic of Tajikistan and its registration, bank accounts opened in accordance with the legislation of the Republic of Tajikistan, separate property allocated in its name for operational management and it can act as a plaintiff, a defendant , as well as as a third party in court, arbitration and sole (arbitration) court.
15. Formation of the regional structure and its reorganization or abolition are carried out in accordance with the legislation of the Republic of Tajikistan.
